Consultation on amendment to Regulation 13 of the Waste Regulations

This joint consultation with the Department for Environment, Food and Rural Affairs (Defra) is reviewing Regulation 13 of the Waste Regulations.

Regulation 13 (2) sets out that co-mingled collection is a form of separate collection

We now believe that the current regulation does not accurately reflect the revised Waste Framework Directive 2008/98/EC on separate collection of recycling.

We are consulting on changes to this regulation so co-mingled collection (different items are collected for recycling together) is not the same as separate collection.

We are also consulting on changes to Regulation 13(3) as it does not include the qualification that the duty for separate collection applies where separate collection is technically, environmentally and economically practicable, and necessary to meet the appropriate quality standards for the relevant recycling sectors.
